Acceptable Use Policy

This Acceptable Use Policy (“AUP”) describes activities that are not permitted on Rocky. It is incorporated by reference into the Rocky Terms of Service. Violation of this AUP is a breach of the Terms of Service and may result in immediate suspension or termination of your account, with or without notice, in addition to any other remedies available to Rocky AI LLC under law.
By using Rocky, you agree to follow this AUP. If you are uncertain whether an intended use is permitted, contact us at rocky@userocky.com before proceeding.
1. General Prohibitions
You may not use Rocky to:
- Violate any applicable federal, state, or local law, regulation, or court order, including any law governing real estate, fair housing, brokerage, lending, securities, consumer protection, or privacy;
- Engage in fraud, misrepresentation, deceptive practices, or any activity intended to mislead another person;
- Infringe, misappropriate, or violate any third party’s intellectual property, contractual, privacy, or publicity rights;
- Submit content that you do not have the legal right to submit, or that you are contractually prohibited from disclosing;
- Stalk, harass, threaten, defame, or harm any individual or entity; or
- Engage in any activity that could expose Rocky AI LLC or its users to legal liability, regulatory action, or reputational harm.
2. Real Estate–Specific Prohibitions
Because Rocky is a real estate tool, the following uses are specifically prohibited:
- Fair Housing violations. You may not use Rocky to draft, generate, or distribute any communication, listing, screening criteria, or outreach that discriminates against any person on the basis of race, color, religion, sex (including gender identity and sexual orientation), familial status, national origin, disability, or any other protected class under federal, state, or local fair housing laws.
- Tenant screening misuse. You may not use Rocky to evaluate, score, rank, or make adverse decisions about individual tenants, applicants, or borrowers. Rocky is a property and deal screening tool, not a tenant or consumer screening tool, and is not designed or authorized for use under the Fair Credit Reporting Act (FCRA) or any equivalent state law.
- Unlicensed brokerage activity. You may not use Rocky to engage in any activity that requires a real estate brokerage license in your jurisdiction if you do not hold such a license. Rocky is a software tool, not a license substitute, and using Rocky to list property, solicit clients, negotiate transactions, or otherwise act as a broker without a license is your sole responsibility and is prohibited.
- License or jurisdiction violations. You may not use Rocky in any manner that violates your real estate license, your brokerage firm’s policies, your state’s licensing rules, or any agency relationship you owe to a client, principal, or counterparty.
- Wholesaling fraud and concealment. You may not use Rocky to conceal a wholesale or assignment fee from a seller or buyer in any jurisdiction where disclosure is required, to misrepresent your role in a transaction, or to evade laws governing wholesaling, assignment, or contract flipping.
- Mortgage and lending fraud. You may not use Rocky to prepare, support, or facilitate any application, statement, or representation to a lender, investor, appraiser, or government agency that you know or reasonably should know is false, inflated, fabricated, or misleading, including with respect to income, occupancy, value, rent rolls, or operating figures.
- Appraisal and valuation manipulation. You may not use Rocky to generate or distribute comparable sales information, valuations, or broker price opinions for the purpose of influencing an appraisal, supporting a fraudulent transaction, or representing Rocky’s output as a licensed appraisal or BPO.
- Securities offerings. You may not use Rocky to draft, support, or distribute any offering of securities (including syndications, fund interests, or fractional ownership interests) without engaging qualified securities counsel and complying with all applicable federal and state securities laws. Rocky is not authorized for use in preparing offering documents, private placement memoranda, or solicitation materials.
- Predatory or coercive outreach. You may not use Rocky to draft, send, or distribute outreach to homeowners in distress (including those in foreclosure, probate, or financial hardship) in a manner that violates state-specific foreclosure consultant, equity skimming, or predatory practice statutes.
- Spam and unsolicited outreach. You may not use Rocky to generate or send bulk unsolicited emails, text messages, calls, or other communications in violation of the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), state Do-Not-Call lists, or any other applicable anti-spam or telemarketing law.
- Disclosure violations. You may not use Rocky to conceal material facts that you are legally required to disclose to a counterparty, including known defects, environmental conditions, title issues, lien status, or pending litigation.
3. Data and Content Prohibitions
You may not submit to Rocky any of the following:
- Social Security numbers, taxpayer identification numbers, or other government-issued ID numbers;
- Bank account numbers, routing numbers, full credit card numbers, or other financial account credentials;
- Full dates of birth, driver’s license numbers, or passport numbers;
- Tenant screening reports, credit reports, background check results, eviction records, or any consumer report subject to the Fair Credit Reporting Act, identifying any person by name;
- Protected health information subject to HIPAA;
- Confidential business information of a third party that you are not authorized to share;
- Login credentials, API keys, private keys, or other authentication secrets for any system;
- Sexually explicit content, content depicting minors in any sexual or exploitative context, or content that promotes violence, terrorism, or self-harm;
- Malware, viruses, or any code intended to disrupt or compromise any system;
- Content you know to be false and that is intended to manipulate Rocky’s outputs or training in any way.
If you accidentally submit any of the above, contact us at rocky@userocky.com and we will work with you to remove it from active storage.
4. Technical Prohibitions
You may not, and may not assist any third party to:
- Attempt to access, probe, scan, or test the vulnerability of any Rocky system, network, or endpoint other than as part of a coordinated disclosure with Rocky AI LLC;
- Attempt to extract, copy, reproduce, reverse engineer, or derive Rocky’s system prompts, model weights, internal logic, or proprietary algorithms;
- Use any automated means (bots, scrapers, headless browsers, scripted clients) to access Rocky, except through documented and authorized API endpoints;
- Attempt to bypass rate limits, authentication, tier gates, or any other access control;
- Share account credentials, session tokens, or API keys with any other person or entity, or operate multiple accounts to evade limits or bans;
- Resell, sublicense, rent, or otherwise commercially redistribute access to Rocky;
- Use Rocky to develop, train, or improve any competing AI product, model, or service;
- Interfere with, disrupt, or place an unreasonable load on Rocky’s infrastructure, including via denial-of-service attempts or abusive query patterns; or
- Remove, alter, or obscure any copyright, trademark, disclaimer, or proprietary notice in Rocky’s interface or generated documents.
5. AI-Specific Prohibitions
- You may not present Rocky’s output as the work of a licensed professional (broker, attorney, appraiser, accountant, lender, inspector, etc.) or as a professional opinion, valuation, appraisal, or legal advice.
- You may not use Rocky’s output as the sole basis for any consequential decision affecting another person’s housing, employment, credit, insurance, or legal rights.
- You may not use Rocky in any high-stakes automated decision pipeline that operates on individuals (e.g., automated tenant approvals, automated loan decisions) without independent human review by a qualified professional.
- You may not attempt to use Rocky to generate content that impersonates a real person, including by drafting communications signed in a real person’s name without their authorization.
6. Reporting Abuse
If you become aware of any violation of this AUP, or of any security issue affecting Rocky, please report it to rocky@userocky.com. We take all reports seriously and will investigate.
7. Enforcement
We may investigate suspected violations of this AUP using any reasonable means, including reviewing system logs and, where necessary and with documented internal authorization, account content. We may take any action we consider appropriate, including:
- Warning the user;
- Suspending or restricting access to specific features;
- Suspending the account temporarily;
- Terminating the account with or without refund (refunds are not provided for accounts terminated for AUP violations);
- Removing or refusing to process specific content; and
- Reporting violations to law enforcement, regulators, or affected third parties where required by law or where, in our reasonable judgment, the violation presents a risk of imminent harm.
We are not obligated to give advance notice before taking enforcement action when, in our reasonable judgment, advance notice would create a risk of harm, evidence destruction, or further violation.
8. Changes to This AUP
We may update this AUP from time to time. Material changes will be communicated via email to your registered address at least 14 days before they take effect, except where a faster update is required to address a specific abuse pattern or legal requirement. The current version is always available at userocky.com.
